Arizona Man to Be Resentenced After AI Video of Victim Shown in Court
Summary
Gabriel Paul Horcasitas, 55, will be resentenced after an Arizona appeals court ruled that an AI-generated video message from his dead victim was improperly shown before sentencing. A jury had convicted him of shooting and killing Christopher Pelkey, 37, during a 2021 road-rage confrontation at a red light, and he received a 10-year prison sentence. Horcasitas's legal team argued that the trial judge should not have admitted the video, which Pelkey's family created using voice recordings, videos and photographs. The appeals court agreed, saying the clip did not document an event or record a particular moment; instead, it depicted the victim and thoughts imagined by his sister. In the video, an AI version of Pelkey expressed regret about the confrontation, said they might have been friends in another life, and spoke about forgiveness. Judge Todd Lang had welcomed the presentation at the original sentencing and said he heard forgiveness in it. The appeals ruling leaves the conviction in place but requires a new sentencing proceeding.
